ATO Trustee Declaration – (NAT71089)
From 1 July 2007, all new trustees (and directors of corporate trustees) of an SMSF are required to sign a declaration, in the approved form, within 21 days of becoming a trustee or a director of the corporate trustee. The declaration aims to ensure that new trustees (or directors of corporate trustees) understand their obligations and responsibilities.
The declaration contains key information for managing an SMSF including information about:
- general trustee duties
- investment restrictions
- the sole purpose test, and
- record-keeping, reporting and lodgement obligations
Self managed super funds – Key messages for trustees (NAT 71128, PDF, 103KB) should be read in conjunction with the declaration. We recommend that trustees keep this fact sheet together with a copy of the trustee declaration to remind them of their duties and responsibilities when making decisions on behalf their fund.
Capital Gains Tax Election Form – (NAT 71161)
You should complete this election if contributions have been made to your super, during the financial year from the disposal of certain small business assets, and you want to exclude these contributions from the non-concessional contributions cap, and have not reached your $1 million CGT cap amount – this amount is indexed on an annual basis and rounded down to the nearest $5,000.

Authority to Release Excess Contributions Tax and Statement – (NAT71451)
You will receive this release authority and statement because your member has not complied with a Compulsory release authority and statement to release the full amount of an excess non-concessional contributions tax liability from their super.
The release authority requires you to release and pay an amount up to the amount nominated in section C from your member’s account within 30 days of receiving this release authority.
You must complete sections D and E and give the release authority statement to us and provide a copy to your member within 30 days after making the payment.
Penalties may apply if you don’t make the required payment to us within 30 days of receiving this release authority or give the completed release authority statement to us and a copy to your member within 30 days of making the payment.

Deduction for Personal Super Contributions – (NAT71121)
If you intend to claim a tax deduction for your personal super contributions, remember that you must complete a Notice of intent to claim or vary a deduction for personal super contributions form (NAT71121).
As an SMSF trustee, you will also need to complete an ‘acknowledgement’ of the valid notice you have completed.
This means you will need to keep records of the following information:
- the date the original notice was completed
- any subsequent variations to the original notice
- your SMSF member details
- the total amount of personal contributions that the original notice covers and, of those contributions
- the amount you intend to claim as a deduction
- either the dates the contributions were made or the income year they were made in
The notice and acknowledgment must be completed by whichever of the following occurs first:
- before you lodge your individual income tax return in the year the contributions were made
- by the end of the income year following the income year the contributions were made.

Request to Transfer Whole Balance of Superannuation Benefits Between Funds – (NAT71223)
The Request to transfer whole balance of superannuation benefits between funds form, otherwise known as the portability form, allows members to transfer their benefits between funds.
Members cannot use this form to:
- transfer part of their super balance, they must transfer the whole balance
- transfer benefits if they don’t know where they are located
- transfer benefits from multiple funds, they must use a separate form for each fund
- transfer benefits where certain conditions or circumstances don’t allow it, for example, if there is a super agreement under the Family Law Act 1975 in place
- open a super account, or
- change the fund their employer pays contributions to on their behalf. Use Choosing a super fund (NAT 13080) to do this.

PAYG Payment Summary – Superannuation Income Stream – (NAT70987)
Use this form if you have made superannuation income stream payments, including superannuation income stream lump sum in arrears payments to a person:
– aged under 60 years, or
– aged 60 years and above and the taxable component contains an untaxed element.
You can only pay a superannuation income stream if you are:
– a superannuation fund
– an approved deposit fund (ADF)
– a life insurance company or registered organisation, or
– a retirement savings accounts (RSA) provider.
Do not use this payment summary if you have withheld from payments that are:
- salary or wages paid to an employee, company director or office holder
- non-superannuation annuities – use the PAYG payment summary – individual non-business (NAT 0046)
- under a labour hire arrangement or other specified payment
- under voluntary agreements to withhold
- for supplies where an Australian business number (ABN) was not quoted
- employment termination payments
- superannuation lump sums, or
- personal services income attributed to an individual.

PAYG Payment Summary – Superannuation Lump Sum – (NAT70947)
Use this form if you have paid a superannuation lump sum to any of the following payees:
- a person aged under 60 years
- person aged 60 years and over where the payment contained a taxable component with an untaxed element
- a non-dependant in the event of another person’s death
- the trustee of a deceased estate
You can only pay a superannuation lump sum if you are one of the following:
- a superannuation fund
- an approved deposit fund (ADF)
- a life insurance company or registered organisation, or
- a retirement savings accounts (RSA) provider
Do not use this form for superannuation lump sum payments paid to a person with a terminal medical condition or for amounts you have withheld from any of the following payments:
- salary or wages paid to an employee, company director or office holder
- payment under a labour hire arrangement or other specified payments
- payments under a voluntary agreement to withhold
- payments for supplies where an Australian business number (ABN) was not quoted
- employment termination payments
- payments from superannuation income streams
- personal services income attributed to an individual

Transition to Retirement – Information for Superannuation Professionals – (NAT15258)
The transition to retirement measure allows people who have reached their preservation age, to have access to their superannuation benefits without having to retire or leave their job. This measure allows people to access their superannuation savings by drawing down certain non–commutable superannuation income streams called transition to retirement income streams.
From 1 July 2007, new rules apply to transition to retirement income streams.
Income streams which commenced before 1 July 2007 and that complied with the transition to retirement rules at the time are deemed to satisfy the new requirements and may continue to be paid under the former rules.
